Case Against Ancil Smith Dismissed

A criminal complaint filed in late September against state representative Ancil Smith (D) Leburn, was conditionally dismissed this week in Knott County district court.
Court records showed the case was dismissed with the condition of no contact or communication by Representative Smith with the complaining witness, David Wesley Hayes.

Hayes, a Knott County neighbor of Representative Smith, filed a criminal complaint against Smith on September 23 alleging he committed the offense of assault 4th, terroristic threatening, and harassment.
The complaint alleged that Smith punched Hayes and threatened to get a gun and kill him during a reported dispute between the neighbors over a property line fence.
Last week Smith admitted to hitting Hayes but denied mentioning anything about a gun or threatening Hayes.
The case was dismissed Tuesday.
Ancil Smith represents the 92nd district, which includes Magoffin, Knott, and parts of Letcher counties.
