SALYERSVILLE – This week a Magoffin County grand jury released the following indictment from June 20 after the warrant had been served.
Jeremiah Brown, 39, of Long Branch Road, in Salyersville, is charged with first-degree strangulation (Class C felony) and fourth-degree assault, minor injury (Class A misdemeanor). According to the indictment, on or about February 16, 2024, Brown allegedly impeded the normal breathing or circulation of blood of another person by applying pressure on the throat or neck or by blocking the nose or mouth of that person, as well as intentionally or wantonly caused minor physical injury to that person.
According to the arrest citation from the original reported incident, Patriot Ambulance Service had responded to a home on Long Creek Road in reference to an injured person, who was being taken to Paintsville ARH, with the ambulance service contacting Kentucky State Police.
Trooper M. Spencer met them at the hospital and talked to the victim, who told police the two got into a physical altercation over a Pop-Tart, with Brown allegedly grabbing a knife and holding to the victim’s throat, then threw down the knife and began choking the person.
According to the victim’s statement, Brown allegedly said, “I’m going to kill you,” then choked the victim until the person blacked out. When the victim came to, he reportedly dragged the person to the door of the residence, threw the victim out of the door, causing the person to fall, resulting in an injured knee, according to the police report.
Trooper Spencer noted in the citation he observed multiple hand prints on both sides of the victim’s neck, as well as a bruised, bleeding and scraped knee. Photos were taken of the victim’s injuries.
When police entered the home and made contact with Brown, he told the trooper, “We got into an argument.”
Brown was then read his Miranda Rights, placed into custody and transported to the Big Sandy Regional Detention Center, and released the next day on bond. On August 2 he was served with an arrest warrant from the June 20 indictment and taken back to BSRDC, where he remains at press time.
Brown is set to be arraigned in the case on August 15 at the Magoffin County Justice Center.
Grand jury indictments are currently only being released after the warrants and/or subpoenas are served.
