Grand jury indicts six

SALYERSVILLE – A Magoffin County grand jury released the following six indictments on August 3:

Gardner L. Webb, 31, of Clarksville, IN, is charged with first-degree wanton endangerment of a police officer (Class D felony); and first-degree fleeing and evading police, motor vehicle (Class D felony). According to the indictment, on or about April 26, 2023, Webb allegedly engaged in conduct that created a substantial danger of death or serious physical injury to police officer Kentucky State Police Trooper Billy Ball, while also using a vehicle to attempt to elude or flee police.

Amanda L. Webb, 26, of Sellersbury, IN, is charged with first-degree trafficking in a controlled substance greater than or equal to 10 dosage units of a drug unspecified, first offense (Class C felony); first-degree possession of a controlled substance, first offense, drug unspecified (Class D felony); tampering with physical evidence (Class D felony); first-degree wanton endangerment, police officer (Class D felony); first-degree fleeing and evading police, motor vehicle (Class D felony); and possession of marijuana (Class B misdemeanor). According to the indictment, on or about April 26, 2023, Webb allegedly possessed a quantity of hydrocodone with the intent to sell, possessed a quantity of a Schedule II narcotic, attempted to destroy or conceal evidence, and fled police apprehension, putting Trooper Ball in danger.

According to the original arrest citation, police attempted to stop the vehicle the Webbs were in on the Mountain Parkway during a traffic safety checkpoint, with the driver, Gardner Webb, reportedly disregarding police commands to stop multiple times, nearly hitting one of the officers and eventually stopped when police blocked the road. Marijuana, 7.7 grams of heroin, 10 blue oxycodone tablets, and two white hydrocodone tablets were recovered from the vehicle. Amanda Webb reportedly told police all drugs in the vehicle were hers and she had told the driver to flee, grabbing the steering wheel when the vehicle nearly hit an officer.

Nicholas Coleman, 54, of Elkhorn City, KY; Tiffany Roberts, 26, of Virgie, KY; and Harley Tubbs, 23, of Sidney, KY, each were indicted on the charges of first-degree trafficking in a controlled substance, greater than or equal to two grams of methamphetamine, first offense (Class C felony); and first-degree possession of a controlled substance, first offense, drug unspecified (Class D felony). According to the indictment, on or about April 13, 2023, the three allegedly possessed a quantity of methamphetamine with the intent to distribute, as well as possessed a quantity of a Schedule I and Schedule II narcotic.

According to the original arrest citations issued in April, the three were stopped in a traffic safety checkpoint on the Mountain Parkway and when the driver (Coleman) was unable to locate his insurance card and proof of registration, they were asked to pull over. Police reportedly found a loaded syringe Tubbs claimed was filled with suboxone, half an ounce of believed heroin and fentanyl, and one pound of methamphetamine. Neither occupant claimed the recovered heroin and fentanyl or methamphetamine, according to the police reports.

Gregory Moore, 34, of McDowell, KY, is indicted on one count of first-degree trafficking in a controlled substance, first offense, greater than or equal to two grams of methamphetamine (a Class C felony). According to the indictment, on or about January 27, 2020, Moore allegedly possessed a quantity of methamphetamine with the intent to distribute.
