LITTERAL FORK – A Magoffin man evaded police by hitting the hills when police went to serve him with a felony arrest warrant.
On July 25, Magoffin County Sheriff Department Deputy Matt Baily went to a Litteral Fork home to execute a felony arrest warrant against Scotty Marshall, 39, of Salyersville. Police knocked on the door and Marshall answered it, and he was informed there was a warrant for his arrest and he was under arrest. He was instructed to step outside, turn around and place his hands behind his back, to which he complied, according to the arrest warrant.
After stepping out into the yard, turning around and placing his hands behind his back, but before police could handcuff him, Marshall pulled away from police, and escaped custody by fleeing on foot and running through the hills, preventing police from effecting the arrest, according to the warrant.
Marshall was arrested two days later without incident and is still being held at the Big Sandy Regional Detention Center, charged with second-degree escape, third-degree fleeing or evading police, and resisting arrest, in addition to the original third-degree burglary charge.
