SALYERSVILLE – A Magoffin County grand jury handed down the following indictments, which were only released this week after the defendants were served in their respective cases:
Michael John Burkes, 49, of Lakeville Road, in Salyersville, is charged with first-degree possession of a controlled substance, first offense, methamphetamine (Class D felony); two counts of first-degree wanton endangerment (Class D felony); and operating a motor vehicle under the influence of a controlled substance, second offense, aggravating circumstances (Class A misdemeanor). According to the indictment, on or about January 18, 2025, Burkes allegedly possessed a quantity of methamphetamine, engaged in conduct which created a substantial danger of death or serious injury to two other people, and operated a motor vehicle while under the influence of a controlled substance that impaired his driving ability.
Kimberly Compton, 40, of Elk Creek Road, in Salyersville, is charged with aggravated trafficking in a controlled substance, greater than or equal to 28 grams of fentanyl (Class B felony); first-degree possession of a controlled substance, first offense, drug unspecified (Class D felony); and possession of drug paraphernalia (Class A misdemeanor). According to the indictment, on or about February 20 and 21, 2025, Compton allegedly possessed with the intent to distribute a quantity of fentanyl, as well as possessed a controlled substance and drug paraphernalia.
Jeremiah C. Mahan, 31, of Prestonsburg, is charged with first-degree trafficking in a controlled substance, first offense, greater than or equal to 4 grams of cocaine (Class C felony); first-degree trafficking in a controlled substance, first offense, less than 2 grams of methamphetamine (Class D felony); and possession of drug paraphernalia (Class A misdemeanor). According to the indictment, on or about June 23, 2025, Mahan allegedly possessed with the intent to distribute quantities of cocaine and methamphetamine, as well as possessed drug paraphernalia.
Steven Davis, 42, of Inez, is charged with possession of a handgun by a convicted felon (Class C felony). According to the indictment, on or about February 20 – 21, 2025, Davis allegedly possessed a handgun while having previously been convicted of a felony.
In a separate indictment, Davis was charged with aggravated trafficking in a controlled substance, greater than or equal to 28 grams of fentanyl (Class B felony); first-degree possession of a controlled substance, first offense, drug unspecified (Class D felony); and possession of drug paraphernalia (Class A misdemeanor). According to the indictment, on or about February 20 and 21, 2025, Davis allegedly possessed with the intent to distribute a quantity of fentanyl, as well as possessed a controlled substance and drug paraphernalia.
Jesse Hicks, 43, of Morehead, is charged with first-degree possession of a controlled substance, first offense, methamphetamine (Class D felony); second-degree criminal mischief (Class A misdemeanor); possession of drug paraphernalia (Class A misdemeanor); and public intoxication of a controlled substance, excluding alcohol (Class B misdemeanor). According to the indictment, on or about June 10, 2025, Hicks allegedly possessed a quantity of methamphetamine and drug paraphernalia. Hicks allegedly also intentionally and wantonly defaced, destroyed or damaged property owned by the Magoffin County Sheriff Department and appeared in a public place manifestly under the influence of a controlled substance.
Warrants were issued for all the defendants charged in the indictments that were released. Indictments are only released after the defendants are served in their cases.
