Drug trafficking sentencings handed down

SALYERSVILLE – The following sentencing hearings were held on September 3:

Maria Yates, 51, of Salyersville, was sentenced to five years in prison on the amended charge of trafficking in a controlled substance, first degree, first offense, less than 2 grams methamphetamine (a Class D felony), per her plea agreement with the Commonwealth, entered into court on July 2. She must forfeit all seized assets, and will be required to pay all court costs within six months after her release from prison. Yates was given credit for time served.

Mary E. Gipson, 45, of Salyersville, was sentenced to five years in prison, to be probated for a period of five years, after pleaded guilty in July to the amended charge of first-degree trafficking in a controlled substance, first offense, greater than 2 grams methamphetamine (Class C felony). She is required to complete the specialty court program, forfeit all seized assets, pay all court costs within six months, and was credited with time served. During her period of probation, she must undergo a substance abuse evaluation and follow through with all recommendations made as to treatment and to undergo random drug and/or alcohol testing. During the period of probation, Gipson will not be allowed to take any narcotic medication without showing in writing by a physician that there is no reasonable non-narcotic alternative available and the doctor must be within the state of Kentucky. She is also required to use only one pharmacy for all prescription medications. Gipson must obey all rules and regulations of the Treatment Court Program.

Jeremiah Mahan, 32, was sentenced to five years to be probated for a period of five years with the stipulation of completing the Magoffin Specialty Court Program, pleading guilting in August to the charge of first-degree trafficking in a controlled substance, first offense, greater than 4 grams cocaine (Class C felony). He is required to forfeit all seized assets and pay all court costs. During probation, Mahan must undergo a substance abuse evaluation and follow through with all recommendations made as to treatment, as well as undergo random drug and/or alcohol screenings. He is not allowed to take any narcotic medications without showing in writing by a physician that there is no reasonable non-narcotic alternative available and the doctor must be within Kentucky. Mahan must use one pharmacy for all prescription medications during his probation. He must obey all rules and regulations of the Magoffin County Specialty Court program. Mahan is also required to perform 20 hours per week of community labor for Magoffin County during any period of time he is not employed full-time.

All other charges in their above cases were dismissed by the court at sentencing. All cases were seen by Magoffin Circuit Judge Kimberley Childers.
