Four arrested after police go to serve eviction notice at Magoffin Co. home

FAR MIDDLE FORK – Four people were arrested on Sunday after police went to serve an eviction notice at a home on Pat Montgomery Road, off Far Middle Fork in Magoffin County.

On February 20, Magoffin County Sheriff Department Deputies D. Watson and J. Osborne went to a home on Pat Montgomery Road to serve an eviction notice, when a female with an active warrant out of Ohio fled the scene.

Emily Powers, 32, of Ashland, reportedly fled the scene, with a warrant issued for failure to appear, according to jail records. At first, Jessica Lynn Thomas, 27, of Ironton, OH, and Danny Lee Legg, 43, of Franklin Furnace, OH, both told police they did not know Powers, but law enforcement were able to confirm that they had all came to the home together.

Also in the home was Kyle Adam Hitchcock, 30, of Minfird, OH, who when police ran through dispatch was wanted out of Ohio, with Ohio law enforcement willing to come pick him up.

Law enforcement also noted in the arrest citations that Hitchcock had a bag of a green, leafy substance in his pocket and both Hitchcock and Legg were believed to be under the influence.

All four defendants were arrested and taken to the Big Sandy Regional Detention Center. Legg and Thomas were released several hours later, and Powers was released on Wednesday, all pending future court dates. At press time, Hitchcock remains in custody at BSRDC.

Thomas was charged with second-degree hindering prosecution or apprehension; Powers with failure to appear; Legg with second-degree hindering prosecution or apprehension and public intoxication – controlled substance (excludes alcohol); and Hitchcock with fugitive from another state, possession of marijuana and public intoxication – controlled substance (excludes alcohol).
