Grand jury releases indictments

SALYERSVILLE – A Magoffin County grand jury released the following indictments on May 15:

Charles M. McGuire, 49, of Big Lick Road, Salyersville, is charged with first-degree trafficking in a controlled substance, second offense, greater than or equal to two grams of methamphetamine (Class B felony); first-degree possession of a controlled substance, second offense, drug unspecified (Class D felony); trafficking in marijuana, less than eight ounces, second or greater offense (Class D felony); and theft of identity of another without consent (Class D felony). According to the indictment, on or about September 9, 2024, McGuire allegedly manufactured, distributed, dispensed, sold, transferred, or possessed, with the intent to manufacture, distribute or sell a quantity of methamphetamine. He is also accused of possessing a quantity of a controlled substance, trafficked marijuana, and knowingly possessed or used any current or former identifying information of another person with the intent to represent that person for the purpose of obtaining benefits to which he would not entitled.

Michael Williams, 48, of Fox Run, Salyersville, is charged with first-degree trafficking in a controlled substance, first offense, greater than or equal to two grams of methamphetamine (Class C felony). According to the indictment, on or about May 27, 2023, Williams allegedly manufactured, distributed, dispensed, sold, transferred, or possessed, with the intent to manufacture, distribute or sell a quantity of methamphetamine.

Brandon Rife, 39, of Burning Fork Road, Salyersville, is charged with first-degree possession of a controlled substance, second offense, methamphetamine (Class D felony); tampering with physical evidence (Class D felony); resisting arrest (Class A misdemeanor); possession of drug paraphernalia (Class A misdemeanor); and license to be in possession (Class B misdemeanor). According to the indictment, on or about March 19, 2025, Rife allegedly possessed a quantity of methamphetamine and drug paraphernalia, attempted to alter physical evidence to impair its verity or availability in the official proceedings, attempted to prevent a peace officer from effecting an arrest; and failed to have an operator’s license in his possession while operating a motor vehicle.

Jerry Shepherd, 54, of College Street, Salyersville, is charged with first-degree trafficking in a controlled substance, second offense, greater than or equal to two grams of methamphetamine (Class B felony), and second-degree persistent felony offender (penalty enhancement). According to the indictment, on or about March 18, 2025, Shepherd allegedly manufactured, distributed, dispensed, sold, transferred, or possessed, with the intent to manufacture, distribute or sell a quantity of methamphetamine.

Trenton N. Fletcher, 26, of Gun Creek Road, Salyersville, is charged with third-degree burglary (Class D felony) and second-degree criminal mischief (Class A misdemeanor). According to the indictment, on or about March 8, 2025, Fletcher allegedly, with the intent to commit a crime, knowingly entered and/or remained unlawfully in a building owned by another person, and intentionally and wantonly defaced, destroyed or damaged property owned by another person.

Matthew Owens, 50, of Middle Fork Road, Salyersville, is charged with first-degree trafficking in a controlled substance, second offense, greater than two grams of methamphetamine (Class B felony); first-degree trafficking in a controlled substance, second offense, fentanyl (Class B felony); first-degree escape (Class C felony); tampering with physical evidence (Class D felony); possession of drug paraphernalia (Class A misdemeanor); prescription controlled substance not in proper container, first offense (Class A misdemeanor); second-degree persistent felony offender (penalty enhancement). According to the indictment, on or about March 11, 2025, Owens allegedly manufactured, distributed, dispensed, sold, transferred, or possessed, with the intent to manufacture, distribute or sell quantities of methamphetamine and fentanyl, as well as drug paraphernalia. Owens also is accused of escaping from custody of the Magoffin County Sheriff’s Department by use of force and attempted to impair the verity or availability of physical evidence in the official proceedings. He allegedly possessed a controlled substance he was prescribed in a container it was not delivered to him at the time of his arrest.

Warrants were issued for all defendants indicted last week.

Furthermore, the following indictment was released as an arrest warrant was served this week:

Roy Logan Hollon, 45, of Paducah, is charged with third-degree burglary (Class D felony); possession of burglary tools (Class A misdemeanor); public intoxication – controlled substance, excluding alcohol (Class B misdemeanor); and third-degree criminal mischief (Class B misdemeanor). According to the indictment, May 27, 2024, Hollon allegedly, with the intent to commit a crime, knowingly entered or remained unlawfully in a dwelling owned by Poor Boys Produce, which also possessing tools designed or commonly used for forcibly entering a premises, and wantonly damaged property owned by Poor Boys Produce, causing pecuniary loss of less than $500, as well as appearing in public manifestly under the influence of a controlled substance.
