Indictments released

SALYERSVILLE – The following Magoffin County grand jury indictments were released this week after the following defendants were served:

Indicted on June 20:
Audie Banks, 40, of Campton, was indicted on a superseding indictment on June 20, on one count of first-degree trafficking in a controlled substance, first offense, fentanyl (Class C felony). According to the indictment, on or about August 29, 2023, Banks allegedly possessed a quantity of fentanyl with the intent to distribute.

Indicted on July 18:
Terry Neal Cheek, 42, of South River Road, Salyersville, was indicted on July 18, and charged with first-degree possession of a controlled substance, first offense, fentanyl (Class D felony); and first-degree possession of a controlled substance, first offense, methamphetamine (Class D felony). According to the indictment, on or about Aprill 22, 2024, Cheek allegedly possessed quantities of methamphetamine and fentanyl.

Justin Caldwell, 33, of S.E. Licking River Road, Salyersville, is charged with first-degree sodomy (Class B felony) and first-degree sexual abuse. According to the indictment, on or about August 30, 2021, Caldwell allegedly engaged in deviate sexual intercourse with a person and subjected the person to sexual contact by forcible compulsion.

Roseanna L. Poe, 45, of Abe Prater Cemetery Road, in Salyersville, is charged with first-degree possession of a controlled substance, first offense, fentanyl (Class D felony); first-degree possession of a controlled substance (Class D felony), first offense, methamphetamine (Class D felony); three counts of tampering with physical evidence (Class D felony); and controlled substance prescription not in proper container, first offense (Class B misdemeanor). According to the indictment, on or about April 22, 2024, Poe allegedly possessed quantities of fentanyl and methamphetamine, and attempted to destroy evidence.

Henry Clifton, 55, of Prestonsburg, is charged with first-degree possession of a controlled substance, first offense (Class D felony). According to the indictment, won or about February 8, 2024, Clifton allegedly possessed a quantity of fentanyl.

Indicted on August 15:
Mitchell W. Shepherd, 36, of Far Middle Fork, Salyersville, is charged with first-degree possession of a controlled substance, first offense, drug unspecified (Class D felony); first-degree possession of a controlled substance, first offense, methamphetamine (Class D felony); tampering with physical evidence (Class D felony); first-degree possession of a controlled substance, first offense, heroin (Class D felony); operating vehicle with expired operator’s license (Class B misdemeanor). According to the indictment, on or about March 17, 2024, Shepherd allegedly possessed quantities of a controlled substance unspecified, methamphetamine and heroin, attempted to destroy evidence, and operated a motor vehicle while his license was expired.
