Three arrested on drug trafficking charges

MIDDLE FORK – Magoffin County Sheriff’s Department deputies responded to a complaint on Middle Fork on May 1, yielding three arrests and multiple drugs confiscated and believed to be for drug trafficking in the area.

According to the police report, sheriff’s department deputies were responding to a complaint on Therman Dyer Road when they received a drug complaint on Middle Fork.

When they arrived to the location on KY Rt. 30, they checked the residence and everything appeared to be fine, so they checked a second residence, which was a camper. When they knocked on the door, the owner very slowly opened the door and stated a female was naked and getting her clothes on, according to the arrest citations.

While standing at the door waiting to talk to the occupants, police noted the bedroom window was located immediately to the right of the door and they could hear the sound of a drawer sliding and shuffling around in the bedroom, according to the police report.

The owner, identified as Tony Gipson, answered the door and police reported a strong odor of marijuana coming from the camper. Gipson reportedly told police he was sorry she was naked and getting dressed, while police told him they were there for a welfare check, asking if they could step in, at which point Gipson welcomed the deputies into the camper, according to the arrest citations.

When police entered, a female identified herself as Whitney Lynn Davis and was crying, had slurred speech, was stagger and unable to maintain her balance, according to the citations. When running checks on all three occupants of the camper, the female’s information came back as there was no record of anyone with that name and date of birth, so she then stated to police her name was Whitney Leigh-Ann Davis. While police ran that name by dispatch, the female told the other officer her chest was hurting, raising her shirt to show them she had a scar on her chest, stating she had had heart surgery. An ambulance was dispatched to the location and the second name she gave police also came back as no record on file, according to the citation.

While the female was being treated at the ambulance, Gipson told police he did not have any drugs in the camper and “he would go look, if he found any he would place them in my hands.” While that was going on, the deputy went back to the camper door and asked Gipson if he had found anything, with Gipson telling him he had not, asking the officer to come in and “let’s look,” according to the citation.

As Gipson searched the drawers next to the bed, he opened the top drawer and stated, “what is this s**t,” at which time the officer told him not to touch anything and he would check while wearing gloves. Gipson reportedly moved out of the way and the deputy took over the search, finding several items of drug paraphernalia, as well as a black lock box hidden under the bottom of the drawer, and containing methamphetamine and various pills, including oxycodone, Xanax, ecstasy, acetaminophen, carisoprodol, and a powder substance wrapped in aluminum foil, a pill grinder, $1 dollar bill rolled up into a snorting straw, and two boxes of Winchester 380 ammo, according to the police report.

The second male subject, identified as Ivory Moody, also came back with an unidentified name, so he contacted his girlfriend and she sent a photo of a US passport. That information was sent on to Kentucky State Police Post 9 and still nothing on file for him, as well.

After he was placed under arrest, police found Moody’s Kansas operator’s license number and dispatch was able to verify his information.

Gipson assisted in the further search of the camper, where police found two sets of scales, two handguns, and a small bag of marijuana. Both handguns came back clean through a records check and Moody took ownership of the Glock, according to the arrest citations.

After the search was completed, police checked both male occupants, with Gipson showing no signs of pupil response, heavy sweating and acting very nervous.

The three occupants were arrested and charged as follows:

Ivory Moody, age 41, of Leavenworth, Kansas, is charged with trafficking in legend drugs, first offense; trafficking in a controlled substance, first degree, first offense (less than two grams methamphetamine); trafficking in a controlled substance, first degree, first offense (greater than or equal to 10 drug units of an unspecified drug); trafficking in a controlled substance, first degree, first offense (less than 10 dosage units opiates); possession of marijuana; and buying or possessing drug paraphernalia.

Susan D. Roberson, 42, of Plat City, Missouri, is charged with trafficking in legend drugs, first offense; trafficking in a controlled substance, first degree, first offense (less than two grams methamphetamine); trafficking in a controlled substance, first degree, first offense (greater than or equal to 10 drug units of an unspecified drug); trafficking in a controlled substance, first degree, first offense (less than 10 dosage units opiates); possession of marijuana; buying or possessing drug paraphernalia; tampering with physical evidence; possession of a handgun by convicted felon; and giving officer false identifying information.

Tony Baretta Gipson, 46, of Tonganoxie, Kansas, is charged with trafficking in legend drugs, first offense; trafficking in a controlled substance, first degree, first offense (less than two grams methamphetamine); trafficking in a controlled substance, first degree, first offense (greater than or equal to 10 drug units of an unspecified drug); trafficking in a controlled substance, first degree, first offense (less than 10 dosage units opiates); possession of marijuana; buying or possessing drug paraphernalia; tampering with physical evidence; and possession of a handgun by convicted felon.

The three were taken to the Big Sandy Regional Detention Center, where Moody and Gipson have since been released on bond, with Roberson still being held at the jail, pending future court dates.
