SALYERSVILLE – A Magoffin County man was arrested on Saturday morning after being caught on video attempting to break into a home.
According to the police report, Magoffin County Sheriff Department Deputy D. Howard responded to an attempted burglary on November 21. When law enforcement arrived to the home, Damien Toby Spears, 35, of Salyersville, was sitting on the porch of the next-door neighbor’s. The homeowner’s family was at the residence, telling police that Spears had tried to kick in the door and he also tried to break into a window at the back of the house. Law enforcement reported the rear window screen was pulled out and a piece of the window was chipped.
Family of the homeowner gave police a picture from the camera system, reportedly showing Spears standing by the front door of the residence. At the time the report was made, the homeowner was trying to retrieve video footage of Spears kicking the door.
Spears was arrested and taken to the Big Sandy Regional Detention Center, where he remains at press time, facing the charges of third-degree criminal trespassing and third-degree attempted burglary.
