SALYERSVILLE – A Magoffin County man was sentenced to three years for rape, sodomy and sexual abuse charges.
In court on Thursday, September 3, Justin McCoy Caldwell, 35, of Salyersville, appeared for sentencing, with Circuit Judge Kimberley Childers accepted the plea agreement entered into court records in June, finding him guilty on the charges of third-degree rape, third-degree sodomy and first-degree sexual abuse, all Class D felonies.
Via the plea agreement made with Attorney General Russell Coleman’s office and accepted by the court, he agreed to a three-year prison sentence and to register as a lifetime sex offender (with a five-year conditional discharge), as well as a 10-year interpersonal protection order and to have no contact with the victim.
According to the sentencing order, Caldwell must have no contact with children or reside in a setting with children without the express prior approval of his therapist and community supervision agent. He must fully inform any potential partner in advance of his sex offense history, including treatment status. He will not be allowed computer access initially, with a graduated period of access under the supervision of his treatment provider and community supervision agent. He must seek mental health treatment for any mental health conditions that may arise and follow all recommended course treatment. The sentencing listed that Caldwell “is not amenable to sex offender treatment,” but also stated that he must enter and complete a sex offender treatment program and follow all treatment guidelines and program rules. He will be financially responsible for any and all treatment where his attendance is required.
Caldwell was given credit for time served and, at press time, he is being held at the Big Sandy Regional Detention Center, with his tentative release date set for February 25, 2029, though he will be eligible for parole in December this year, according to the Kentucky Online Offender Lookup (KOOL) website.
