Grand jury releases indictment

SALYERSVILLE – A Magoffin County grand jury released the following indictment this week, issued on September 17:

Wesley C. Howard, 36, of Salyersville, is charged with fourth-degree assault (Class A misdemeanor); second-degree strangulation (Class D felony); and second-degree persistent felony offender.

According to the indictment, on or about December 14, 2025, Howard allegedly punched another person repeatedly, thereby causing physical injury, and is also accused of impeding the normal breathing or circulation of blood of that person by reportedly using his knee to apply pressure on the throat of that person.

Also, the indictment states that Howard had previously been convicted of assault under extreme emotional disturbance (two counts), and sentenced to five years probated for five years, dated May 8, 2025.

Howard is currently being held at the Rowan County Detention Center, with no bond in the prior Morgan County case and with a $10,000 cash bond in the Magoffin County case, according to the jail records.

An arraignment hearing is scheduled for November 5 at 10 a.m. at the Magoffin County Justice Center.

Indictments are released to the media only after the defendants are served in their respective cases.

Editor’s Note: The indictment or charge of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.
