Driver indicted in Estill Co. fatal wreck

ESTILL COUNTY – The driver in a 2021 fatal wreck has now been indicted. The wreck resulted in the death of a Powell County man and serious injuries to a Salyersville man.

Marsha Maggard, 38 years old of Irvine, is now facing charges of first-degree assault and second-degree manslaughter. While she was being held at the Three Forks Regional Jail, she has since been released, with her next court hearing in the case slated for December 6 at 12:30 p.m.

According to the initial investigation following the October 9, 2021, wreck, KSP told the SI that the evidence indicated a 2005 Toyota Highlander, operated by Marsha Maggard, was traveling west on Spout Springs Rd., when she crossed the center line and collided with a 2004 Harley Davidson motorcycle, operated by Michael Helton, 59 years old of Stanton, KY, and a 1998 Harley Davidson motorcycle, operated by William Hall, 45 years old, of Salyersville. Both motorcycle operators were ejected from their bikes.

As a result of the wreck, Helton was pronounced deceased at the scene by the Estill County Coroner and William Hall was transported from the scene by Estill County EMS to Marcum and Wallace Hospital, then airlifted to the University of Kentucky Hospital with life-threatening injuries. He reportedly had to undergo numerous surgeries to treat his extensive injuries.

The SI will release more information on this case as it becomes available.

Editor’s Note: The indictment or charge of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.
