SALYERSVILLE – The following order was issued in Magoffin County Circuit Court restricting photos being taken, filming or recording in common areas of the Magoffin County Justice Center on Tuesday, December 13:
The Court being concerned with the decorum, security, and protection of persons doing business within the Magoffin County Justice Center, and finding it necessary to provide a secure facility for the purpose of conducting court business, and after consultation with the Administrative Office of the Courts Division of Court Security and the Magoffin County Sheriff’s Office, the Chief Circuit Judge does hereby ORDER;
Pursuant to SCR 1.040(3)(g) that there shall be no photographing, filming, or recording in common areas of the Magoffin County Justice Center except as provided herein.
The Magoffin County Justice Center includes all areas within the exterior walls of the building. Common areas include entrances and exits, lobbies, hallways, stairs, elevators, offices, and courtrooms not in use. This order does not restrict these activities when conducted on court premises outside the entrances and exits of the Magoffin County Justice Center, so long as these activities do not obstruct access to or from the building or compromise security, as determined by a court security officer. Activities that obstruct access or compromise security will be considered a violation of this order.
Individuals, including media, may seek permission to photograph, film, or record in common areas. These requests will be considered, and a response provided by the Chief Circuit Judge and should be directed to Angela Short at angelashort@kycourts.net.
Permission to photograph, film, or record in a courtroom in connection to a court proceeding is left to the discretion of the judge presiding over the court proceeding at issue. Any authorization to photograph, film, or record in a courtroom in connection with a court proceeding does not extend to the common areas of the Magoffin County Justice Center or otherwise exempt compliance with this order.
A violation of this order and/or a directive by the Chief Circuit Judge may be the basis for being removed from the courthouse or an order to show cause for contempt.
This order shall be provided to all judicial and nonjudicial personnel assigned to work in the Magoffin County Justice Center and shall be conspicuously posted at entrances and in the common areas of the Magoffin County Justice Center. This order shall be made available to anyone upon request.
