SALYERSVILLE – A Magoffin County grand jury released the following indictment from 2022 as the defendant was served in the case this week:
Anthony Troy Garcia Jr., 28, of Sugar Camp Spur, in Salyersville, is charged with three counts of first-degree wanton endangerment. On or about February 18, 2022, Garcia allegedly engaged in conduct with created a substantial danger of death or serious physical injury for three separate people.
According to the original arrest citation from February 2022, one of Garcia’s neighbors was sitting in his living room when he heard a loud “bang” and drywall flew all over his couch and floor. He looked to his right and saw a large hole in the wall on the other side of his residence close to the front door. In total, there were three people in the home at the time of the incident.
At the time of his arrest, Garcia said his wife was leaving for work and there were dogs barking at her, so he retrieved his handgun form inside the house and he fired one shot behind the dogs to scare them off. He told police that after firing the shot two male subjects came out of the residence behind him, exclaiming that he had shot into their house, according to the citation.
Police found a hole believed to be the caused from the shot, noting in the police report the bullet did not go into the ground. Police further stated “it appears to have bounced off the ground and went straight into the residence behind Mr. Garcia’s.”
Garcia was arrested on September 1 and taken to the Big Sandy Regional Detention Center, where he was released the next day, with an arraignment hearing scheduled for September 4 at the Magoffin County Justice Center.
The indictment was originally handed down on November 3, 2022.
