Burglary, fleeing from police

LIMESTONE BR – A Magoffin County man was arrested after reportedly forcing entry into a residence on Limestone Branch, then running from police.

According to the arrest citation, on the night of Tuesday, May 5, Magoffin County Sheriff Department Deputy W. Lafferty responded to a complaint on Limestone Branch, in Magoffin County, regarding a possible Emergency Protection Order (EPO) violation and burglary in progress.

When law enforcement arrived, Deputy Lafferty observed David Leon Miller, 48, of Salyersville, jump off the front porch of the residence and flee around the rear side of the singlewide trailer, according to the police report. After a short foot pursuit, Miller was detained while attempting to flee up the hill behind the home.

Deputy Lafferty noted that Miller was extremely intoxicated at the time he was detained, with severely slurred speech, was extremely unsteady on his feet, and repeatedly asked the same questions throughout the investigation, according to the police report.

Four witnesses inside the home told police Miller had forced his way through the front door and entered the living room area without permission.

Miller was placed into custody and taken to the Big Sandy Regional Detention Center, and later released, pending future court dates, facing the following charges: second-degree fleeing or evading police (on foot), alcohol intoxication in a public place (first and second offense), and third-degree burglary.
