INDICTMENTS RELEASED

SALYERSVILLE – A Magoffin County grand jury released the following indictments on Thursday, May 16:

Kent Simpkins, 43, of Burning Fork Road, in Salyersville, is charged with three counts of possession and/or view matter portraying a sexual performance by a minor, under 12 years of age (Class C felony); distribution of matter portraying sexual performance by a minor, under 12 years of age, 1st offense (Class C felony); two counts of possession and/or view matter portraying a sexual performance by a minor, over 12 years of age but under 18 years of age, first offense (Class D felony); sexual crimes against an animal (Class D felony). According to the indictment, on or about November 27, 2023, through February 13, 2024, Simpkins allegedly knowingly had in his possession or control any matter (at least three separate images) which visually depicted an actual sexual performance by minors under the age of 12 years old, knowingly sent or caused to be sent int this state for sale or distribution or had in his possession or control any matter which visually depicted an actual sexual performance by minors under 12 years of age, possessed matter which visually depicted an actual sexual performance by minors (two incidents with minors over 12 years old but under 18 years of age), and engaged in sexual contact with an animal.

Will T. Perkins, 34, of West Lick Branch, in Salyersville, is charged with custodial interference (a Class D felony). According to the indictment, on or about June 13, 2022, Perkins allegedly took and kept from lawful custody another person, who was entrusted by authority of law to the custody of another person.

Charles M. McGuire, 48, of Big Lick Road, in Salyersville, is charged with possession of a handgun by a convicted felon (Class C felony). According to the indictment, on or about February 27, 2023, McGuire allegedly possessed, manufactured or transported a handgun when he had previously been convicted of a felony.

Robert W. Miller, 36, of Meadows Branch Road, in Salyersville, is charged with possession of a handgun by a convicted felon (Class C felony). According to the indictment, on or about February 6, 2022, Miller allegedly possessed, manufactured or transported a handgun when he had previously been convicted of a felony.
Robert W. Miller, 36, of Meadows Branch Road, in Salyersville, is charged with first-degree trafficking in a controlled substance, first offense, greater than or equal to 2 grams of methamphetamine (Class C felony); and first-degree fleeing and evading police, first degree, on foot (Class D felony). According to the indictment, on or about February 6, 2022, Miller allegedly manufactured, distributed, dispensed, sold, transferred, or possessed with the intent to manufacture, distribute or sell a quantity of methamphetamine, as well as wantonly disobeyed a direction to stop, given by a person recognized to be a peace officer.

Michael D. Williams, 47, of Ed Hensley Road, in Salyersville, is charged with first-degree possession of a controlled substance, first offense, methamphetamine (Class D felony). According to the indictment, on or about August 22, 2022, Williams allegedly possessed a quantity of methamphetamine.

James G. Bailey, 51, of Little Road, in Salyersville, is charged with second-degree assault (Class C felony). According to the indictment, on or about August 28, 2022, Bailey allegedly wantonly caused serious physical injury to another person by means of a deadly weapon or a dangerous instrument.

Felisha Crace, 34, of Jackson, is charged with possession of a handgun by a convicted felon (Class C felony). According to the indictment, on or about March 21, 2024, Crace allegedly possessed, manufactured or transported a handgun when he had previously been convicted of a felony.

Felisha Crace, 34, of Jackson, is charged with first-degree trafficking in a controlled substance, first offense, greater than or equal to 2 grams of methamphetamine (Class C felony); and possession of drug paraphernalia (Class A misdemeanor). According to the indictment, on or about March 21, 2024, Crace allegedly manufactured, distributed, dispensed, sold, transferred, or possessed with the intent to manufacture, distribute or sell a quantity of methamphetamine, as well as drug paraphernalia with the intent to use for the purpose of inhaling, ingesting or otherwise introducing into the human body a controlled substance.

Jerry Finch, 46, of College Street, in Salyersville, is charged with possession of a handgun by a convicted felon (Class C felony). According to the indictment, on or about March 21, 2024, Finch allegedly possessed, manufactured or transported a handgun when he had previously been convicted of a felony.

Jerry Finch, 46, of College Street, in Salyersville, is charged with first-degree trafficking in a controlled substance, first offense, greater than or equal to 2 grams of methamphetamine (Class C felony); and possession of drug paraphernalia (Class A misdemeanor). According to the indictment, on or about March 21, 2024, Finch allegedly manufactured, distributed, dispensed, sold, transferred, or possessed with the intent to manufacture, distribute or sell a quantity of methamphetamine, as well as drug paraphernalia with the intent to use for the purpose of inhaling, ingesting or otherwise introducing into the human body a controlled substance.

Armando I. Elizondo, 24, of Lexington, is charged with possession of a handgun by a convicted felon (Class C felony). According to the indictment, on or about March 7, 2024, Elizondo allegedly possessed, manufactured or transported a handgun when he had previously been convicted of a felony.

Armando I. Elizondo, 24, of Lexington, is charged with first-degree trafficking in a controlled substance, first offense, greater than or equal to 4 grams of cocaine (Class C felony); trafficking in marijuana, first offense, 8 ounces to less than 5 pounds (Class D felony); failure to register transfer of a motor vehicle (Class A misdemeanor); and failure of owner to maintain required insurance, first offense (Class B misdemeanor). According to the indictment, on or about March 7, 2024, Elizondo allegedly manufactured, distributed, dispensed, sold, transferred, or possessed with the intent to manufacture, distribute or sell quantities of cocaine and marijuana; as well as failed to register the transfer of a motor vehicle and maintain insurance as required by law.

Jeffrey Marshall, 50, of E. Maple St., in Salyersville, is charged with third-degree burglary (Class D felony); third-degree criminal mischief (Class B misdemeanor); and third-degree criminal trespassing (violation). According to the indictment, on or about February 29, 2024, Marshall allegedly knowingly entered or remained unlawfully in a dwelling owned by Dollar Tree, intentionally and wantonly defaced, destroyed or damaged property owned by Dollar Tree, and entered or remained unlawfully upon premises as to which notice against trespass was given by fencing.

Arrest warrants were issued for all defendants charged in these indictments.
