SALYERSVILLE – A Magoffin County man was arrested on a warrant from Breathitt County alleging he had taken money for a job he refused to complete.
According to the complaint warrant, Henry Doug Allen, 47, of Salyersville, was arrested by the Magoffin County Sheriff Department on Tuesday night, November 19, on the charge of theft by deception – including cold checks 0 $10,000 or more. The felony charge comes out of Breathitt County, with the warrant issued on Monday this week.
According to the warrant, in July 2023, Allen allegedly obtained property or services of another by deception with the intent to deprive the person thereof when he created a false impression when he entered into a written contract with the victim for home remodeling for the amount of $58,000. When the victim paid him the amount of approximately $33,500, he performed approximately $10,000 of work. Allegedly, he refused to return to complete the job and when he refused to return the balance of the money paid to him by the victim, he deprived that person of the amount of approximately $23,500.
Allen was taken to the Big Sandy Regional Detention Center, where he was released from on Wednesday on bond, pending future court dates.
Last month Allen was indicted in Magoffin County and charged with one count of theft by deception, including cold checks, $10,000 or more, a Class C felony. According to the indictment, on or about December 7, 2022, through May 10, 2024, Allen was given three checks totaling the amount of $22,755, and allegedly, with the intent to deprive the person thereof, intentionally created or reinforced false impression as to his intention.
In a separate indictment Allen was also charged with theft by failure to make required disposition of property, $1,000 < $10,000, a Class D felony. According to the indictment, on or about June 8, 2023, through March 15, 2024, Allen allegedly unlawfully obtained property belonging to another person, kept the property, and dealt with it as his own, with the property valued at $2,905. Allen was served a court summons in both Magoffin County cases.
