SALYERSVILLE – The Magoffin County Fiscal Court met in special session on Monday, September 16, discussing a new garbage collection contract and a request for permission for a musician to play at the upcoming Walnut Festival.
Under fund transfers, the court approved the to transfer $60,000 from the general fund to the jail fund.
The court discussed renewing the contract with Rumpke for waste collection services, with the original proposal looking at increasing residential bills to $24 and $19 for seniors. After discussing the issue at the last meeting and receiving some feedback, Rumpke submitted another proposal, deciding to not increase the rates all at once, with the residential bills raising instead to $19 and $15 for seniors, though the rates will increase by small increments each year for the four-year contract. The court discussed that those increases were more reasonable, and unanimously accepted the updated proposed contract with Rumpke.
The fiscal court also approved an agreement and resolution with the Department of Rural and Municipal Aid for a bridge replacement under the 80/20 Bridge Program. Magoffin County Judge/Executive Matthew Wireman explained that will be used to put in a large culvert at the mouth of Dotson Branch to hopefully correct the flow of water in that area. He said it will affect a lot of people in that area when it has to be installed, but they hope it will prevent flooding issues in that area of Burning Fork.
They approved to extend the service agreement with Boyd Cat for the generator at the Magoffin County Courthouse. Judge Wireman said the extended warranty has expired, but this will extend the warranty to cover the generator to ensure it will continue to work.
The court approved a petition to extend S Hale Road (CR-1163D) per KRS 178.080. Wireman explained that they had previously taken this portion off of the county road system, but all affected landowners had signed the petition to extend this road, located in Sand Bottom.
They received the annual financial report from the Magoffin County Conservation District for July 1, 2023 through June 30, 2024, as required by law. The court must receive the annual report, but are not responsible for any decisions made by the conservation district.
They also acknowledged receipt of tax rates from all taxing districts to be placed on tax bills.
The court agreed to advertise for sealed bids on sheriff’s office vehicles not in use.
Judge Wireman explained that a band had requested to play at the Walnut Festival, but one of the band members is a registered sex offender. Wireman said he would not approve it, especially given that the Half Mountain Battlefield Park, where the Walnut Festival will be held on September 28, is located in very close proximity to South Magoffin Elementary. When Wireman would not approve the band to play on county-owned property, the band then requested that the decision go to the governing body, the fiscal court.
The school board would also have to approve the band to be able to play that close to the school, Wireman said, and the schools superintendent indicated that they will not. Under Wireman’s recommendations, the fiscal court unanimously rejected the request to allow the individual named in the request to be able to be within 1,000 feet of a school.
The next regularly scheduled Magoffin County Fiscal Court meeting is tentatively slated for October 15 at 6 p.m. in the Magoffin County Courthouse Albert Patrick Building.
