Grand jury releases indictments

SALYERSVILLE – A Magoffin County grand jury released the following indictments on Thursday, June 20:

Clarence Wayne Gipson, 50, of Allen Drive, in Salyersville, is charged with two counts of third-degree burglary (Class D felonies) and two counts of first-degree criminal mischief (Class D felonies). According to the indictment, on or about March 23, 2024, Gipson allegedly entered or remained unlawfully in Hometown Ace Hardware and Smokin’ Grub, and intentionally and wantonly defaced or damaged property owned by both businesses, causing pecuniary losses totaling over $2,000.

Tony R. Endicott, 58, of West Van Lear, is charged with first-degree trafficking in a controlled substance, first offense, greater than or equal to 2 grams of methamphetamine (Class C felony); and possession drug paraphernalia (Class A misdemeanor). According to the indictment, on or about April 25 to April 26, 2024, Endicott allegedly possessed a quantity of methamphetamine with the intent to distribute it, as well as possessed drug paraphernalia.

Enrique M. Beard, 39, of Lexington, is charged with first-degree trafficking in a controlled substance, first offense, greater than or equal to 4 grams of cocaine (Class B felony); first-degree trafficking in a controlled substance, second offense, greater than or equal to 2 grams of methamphetamine (Class B felony); first-degree trafficking in a controlled substance, second offense, carfentanil or fentanyl derivatives (Class B felony); first-degree trafficking in a controlled substance, second offense, heroin (Class B felony); second-degree trafficking in a controlled substance, first offense, greater than or equal to 20 dosage units, drug unspecified (Class D felony); tampering with physical evidence (Class D felony); and trafficking in marijuana, less than 8 ounces, first offenses (Class A misdemeanor). According to the indictment, on or about February 25, 2024, Beard allegedly possessed quantities of cocaine, methamphetamine, fluorofentanyl, heroin, buprenorphine, and marijuana with the intention of distributing the substances. He is also accused of destroying, mutilating, concealing, removing or altering physical evidence he believed was about to be produced or used in an official proceeding.

Warrants were issued for each of the defendants indicted last Thursday.
