MAN FEDERALLY CHARGED IN CHILD PORN CASE

LONDON – A Magoffin County man was indicted last week in a federal child pornography case.

According to the indictment filed on March 24 at the United States District Court Eastern District of Kentucky, Southern Division, in London, Kentucky, David Keith Jackson, age 53, of Allen Drive, in Salyersville, is charged with two counts of receipt of child pornography and one count of possession of child pornography.

On June 24, 2021, Kentucky State Police’s Electronic Crime Branch arrested Jackson at his residence on Allen Drive after conducting an undercover Crimes Against Children (ICAC) investigation. According to the press release from KSP, the Electronic Crime Branch began the investigation after discovering Jackson uploading images of child sexual exploitation online.

The investigation resulted in the execution of a search warrant at a Salyersville residence on June 25, with equipment used to facilitate the alleged crime seized and take to KSP’s forensic laboratory for examination.

In June, Jackson was arrested without incident and taken to the Big Sandy Regional Detention Center and charged with 20 counts of possessing or viewing matter portraying a minor in a sexual performance and one count of distribution of matter portraying a minor in a sexual performance.

According to the federal indictment, Jackson allegedly received a visual depiction by any means, including by computer, of the production of such visual depiction having involved the use of a minor engaged in sexually explicit conduct. The photos, allegedly received on May 19 and May 20, 2021, involved images of prepubescent females. On February 18, 2020, according to the indictment, Jackson had a cell phone containing visual depictions of a prepubescent minor engaging in sexually explicit conduct (different images than from the first two counts in the indictment), which had been shipped and transported using any means and facility of interstate and foreign commerce and in or affecting interstate commerce, and which were produced using materials that had been mailed, shipped and transported by any means, including by computer.

Jackson was arrested on Monday and is being held at the Pike County Detention Center for the U.S. Marshals. He is slated to be arraigned in the case on Friday, April 1, at the federal courthouse in Pikeville.

Per the indictment, Jackson had to forfeit all electronic items used in the alleged crimes, including, but not limited to, a Samsung Galaxy S9 cell phone, a Samsung Galaxy S10 cell phone, and all software and peripherals which are contained on or associated with the listed smart phones.

Counts 1 and 2 carry penalties of not less than five years imprisonment and not more than 20 years imprisonment, not more than $250,000 fine, and supervised release for not less than five years nor more than life. Count 3 carries a penalty of not more than 20 years imprisonment, not more than $250,000 fine, and supervised release for not less than five years nor more than life. He also faces a mandatory special assessment of $100 per count, restitution of not less than $3,000 per victim, and other possible fees of up to $50,000 per count if convicted.
