SALYERSVILLE – A trespassing complaint led to three people facing drug-trafficking charges last week.
According to the arrest citations, on Wednesday, July 21, Magoffin County Sheriff Department Deputy Jonathan Holbrook received a complaint regarding subjects trespassing at a residence. When he arrived at the home on KY 364, he knocked on the door and noted that he could smell a strong odor of marijuana coming from the residence.
The property owner told police that no one had rented the residence and gave permission for law enforcement to enter the home, according to the citation.
Once inside, police found the bathroom door was locked. When Holbrook pulled on the door to open it, he heard someone flush the toilet.
When Dario Robinson, 30, was out of the bathroom, police found in the toilet several baggies with a large amount of a white, powdery substance. Robinson reportedly told police it was around 10 grams of cocaine that he was flushing, with some of it on himself and on the bathroom floor.
Deputy Holbrook reported in the citation most of the powder substance was dissolved in the toilet water, but a sample was collected and sent to the lab.
Robinson also had $64 in cash on him and police found throughout the residence several scales and cash, as well as a lot of baggies and a scanner to detect if someone was wearing a wire. A small bag of what police believed to be marijuana was located in one of the bedrooms on a shelf.
Robinson, along with two other people who were in the residence at the time, Ashley Johnson, 35, and Jayshawn Robinson, 29, (which police noted had $3,712 and orange pills believed to be Adderall on him at the time of the arrest), were all taken into custody and transported to the Big Sandy Regional Detention Center.
All three suspects were charged with third-degree criminal trespassing; trafficking in a controlled substance, first degree, first offense (greater than or equal to 4 grams cocaine); drug paraphernalia – buy/possess; and possession of marijuana. According to the jail’s records, the two men are also facing charges of possession of a firearm and a handgun by a convicted felon. Dario is also charged with tampering with physical evidence and Jayshawn is charged with possession of a controlled substance. Johnson was released on Tuesday, pending future court dates, while the other two defendants in the case remain at BSRDC at press time.
Preliminary hearings for the three are scheduled for August 2 at the Magoffin County Justice Center.
Important to note, Dario was listed as a Robinson on the arrest citation, a Robinson-Johnson in the jail’s records and as a Johnson in the court files. At press time, the SI cannot confirm which last name is accurate.
