Grand jury releases indictments

SALYERSVILLE – A Magoffin County grand jury released the following indictment on May 4, 2023:

Jeremy P. Kirk, 34, of Mash Fork, in Salyersville, is charged with first-degree wanton endangerment (a Class D felony). According to the indictment, on or about September 26, 2022, Kirk allegedly engaged in conduct that created a substantial danger of death or serious physical injury to another person.

Robert W. Miller, 35, of Meadows Branch, in Salyersville, is charged with first-degree possession of a controlled substance, first offense, cocaine (Class D felony); trafficking in marijuana less than 8 ounces, first offense (Class A misdemeanor); possession of drug paraphernalia (Class A misdemeanor); failure to register transfer of a motor vehicle (Class A misdemeanor); failure of non-owner operator to maintain required insurance, first offense (Class B misdemeanor); and driving on a DUI suspended license, first offense (Class B misdemeanor). According to the indictment, on or about January 15, 2023, Miller allegedly possessed a quantity of cocaine, a Schedule II narcotic, marijuana, and drug paraphernalia, while also driving on a suspended license.

Alden Brown, 59, of Allen Drive, in Salyersville, is charged with possession of a handgun by a convicted felon (a Class C felony); and possession of a defaced firearm (Class A misdemeanor). According to the indictment, on or about December 2, 2022, Brown allegedly possessed a handgun and a defaced firearm, while also being a convicted felon.

James L. Cole, 48, of Rockhouse Fork Road, in Salyersville, is charged with eight counts of possession and/or view matter portraying a sexual performance by a minor less than 12 years of age (Class C felonies). According to the indictment, on or about July 11, 2022, through January 17, 2023, Cole allegedly had in possession or control of images or videos which visually depicted an actual sexual performance by minors under the age of 12.

Rita Blanton, 46, of Holderby Branch, in Salyersville, is charged with first-degree possession of a controlled substance, first offense, drug unspecified (Class D felony). According to the indictment, on or about January 7, 2023, Blanton allegedly possessed a quantity of fentanyl.
Jayshawn Robinson, 30, of Michigan, is charged with trafficking in a controlled substance, first degree, first offense, fentanyl derivatives (Class C felony). According to the indictment, on or about July 21, 2021, Robinson allegedly possessed a quantity with the intent to distribute or sell fentanyl.

Arrest warrants were issued for each of the defendants indicted in Magoffin County last week.
