Grand jury releases indictments

SALYERSVILLE – A Magoffin County grand jury released the following indictments on March 3, 2022:

James Howard, 33, of Licking River Road, Salyersville, is charged with first-degree possession of a controlled substance, first offense, methamphetamine (Class D felony); and operating a motor vehicle under the influence of a controlled substance, first offense (Class B misdemeanor). According to the indictment, on or about May 8, 2021, Howard allegedly possessed a quantity of methamphetamine and operated a motor vehicle under the influence of a controlled substance.

Jennifer Clark, 32, of Kel Patton Branch, Salyersville, is charged with first-degree trafficking in a controlled substance, first offense, greater than or equal to two grams of methamphetamine (Class C felony); first-degree trafficking in a controlled substance, first offense, fentanyl derivatives (Class C felony); possession of marijuana (Class B misdemeanor); and possession of drug paraphernalia (Class A misdemeanor). According to the indictment, on or about January 21, 2022, Clark allegedly possessed quantities of methamphetamine and fentanyl with the intent to distribute, as well as possessed a quantity of marijuana and other drug paraphernalia.

Matthew Sparks, 32, of Kel Patton Branch, Salyersville, is charged with first-degree trafficking in a controlled substance, first offense, greater than or equal to two grams of methamphetamine (Class C felony); first-degree trafficking in a controlled substance, first offense, fentanyl derivatives (Class C felony); possession of marijuana (Class B misdemeanor); possession of drug paraphernalia (Class A misdemeanor); and second-degree persistent felony offender (penalty enhancement). According to the indictment, on or about January 21, 2022, Sparks allegedly possessed quantities of methamphetamine and fentanyl with the intent to distribute, as well as possessed a quantity of marijuana and other drug paraphernalia. At the time Sparks allegedly committed the offenses, he stands convicted of a felony within the last five years (Magoffin County Circuit Court case from 2017).

In a separate indictment, Sparks was also charged with two counts of possession of a handgun by a convicted felon (Class C felony). According to that indictment, on or about January 21, 2022, Sparks allegedly possessed two handguns when he wasn’t allowed to have firearms as a convicted felon.

Warrants were issued for the three indicted last Thursday.

Both Sparks and Clark have been held at the Big Sandy Regional Detention Center since their January 21 arrest.
