Grand jury releases indictments

SALYERSVILLE – A Magoffin County grand jury released the following indictments on May 7:

Larry Martin, 58, of Gifford Road, Salyersville, is charged on one count of first-degree sexual abuse, victim under 12 years of age, which is a Class C felony. According to the indictment, from approximately April 15 through May 15, 2019, Martin allegedly subjected another person to sexual contact who was incapable of consent because the child was less than 12 years of age.

James Allen, 37, of Howard Branch Road, in Salyersville, is charged with the following: second-degree manslaughter (Class C felony); first-degree trafficking in a controlled substance, first offense, fentanyl derivatives (Class C felony); tampering with physical evidence (Class D felony); two counts of fourth-degree controlled substance endangerment to a child (Class D felonies); and possession of drug paraphernalia (Class A misdemeanor). According to the indictment, on or about December 23, 2020, Allen allegedly wantonly caused the death of another person, namely Larry N. Fletcher, when he knowingly distributed a controlled substance with fentanyl derivatives, which reportedly led to Fletcher’s death. He is accused of tampering with physical evidence to impair the investigation and also knowingly either caused or permitting two children to be present where the controlled substance was, as well as possessing drug paraphernalia.

Joshua N. Brown, 22, of George Brown Road, Royalton, is charged with first-degree wanton endangerment of a police officer (Class D felony); first-degree fleeing and evading police, motor vehicle (Class D felony); resisting arrest (Class A misdemeanor); and menacing (Class B misdemeanor). According to the indictment, on or about March 14, 2021, Brown allegedly engaged in conduct that created substantial danger of death or serious injury to Salyersville Police Department Officer Jeremiah Watson, nearly hitting Watson with his car and disobeying police directions to stop, resisted arrest and placed another person in reasonable apprehension of imminent physical injury.

In a separate indictment, but for actions allegedly taken during the same incident, Brown is also facing the following charges: first-degree fleeing and evading police on foot (Class D felony); first-degree fleeing and evading police , motor vehicle (Class D felony); resisting arrest (Class A misdemeanor); second-degree wanton endangerment of a police officer; operating a motor vehicle on suspended or revoked operator’s license (Class B misdemeanor); operating motor vehicle under the influence of alcohol and/or drugs, first offense (Class B misdemeanor); license to be in possession (Class B misdemeanor); failure of non-owner operator to maintain required insurance (Class B misdemeanor); menacing (Class B misdemeanor); no registration receipt (violation); failure to produce insurance card (violation); improper registration plate (violation); rear license no illuminated (violation); no registration plates (violation); speeding 23 MPH over the speed limit (violation); reckless driving (violation)l and improperly on the left side of the road (violation). Brown’s second indictment involved charges relating to his interactions with Kentucky State Police Trooper Tracy Salyer during the same incident, almost hitting Salyer with his vehicle as he attempted to flee. Originally, he was charged with attempted murder of a police officer.

Kyle A. Puhl, 32, of Elroy, Wisconsin, was charged with the following: first-degree fleeing and evading police, motor vehicle (Class D felony); first-degree wanton endangerment of a police officer (Class D felony; second-degree cruelty to animals (Class A misdemeanor); failure of owner to maintain required insurance (Class B misdemeanor); no registration receipt (violation); failure to produce insurance card (violation); reckless driving (violation); and failure to wear seatbelts (violation). According to the indictment, on or about September 9, 2020, Puhl allegedly fled in a motor vehicle from SPD Officer Jeremiah Watson. During the police chase, Puhl reportedly had two large dogs tied to the floorboard of the vehicle with a rope, with the indictment alleging he was intentionally cruel to animals, causing the death of said animals as a result of the cruelty.

Anthony Darrell Saylor, 33, of East Maple Street, Salyersville, is charged with first-degree criminal mischief (Class D felony); first-degree fleeing and evading police, motor vehicle (Class D felony); two counts of first-degree wanton endangerment (Class D felony); second-degree fleeing and evading police on foot (Class A misdemeanor); operating a motor vehicle under the influence of alcohol and/or drugs, first offense (Class B misdemeanor); failure of owner to maintain required insurance, first offense (Class B misdemeanor); failure to notify address change to department of transportation (Class B misdemeanor); no registration plates (violation); no registration plates (violation); no registration receipt (violation); and speeding 20 MPH over the speed limit (violation). According to the indictment, on or about May 22, 2020, Saylor allegedly fled in a motor vehicle and then on foot from SPD Officer Jeremiah Watson. Saylor was reportedly under the influence of alcohol and/or drugs during the police chase and had two people in the car at the time.

Arrest warrants were issued for each of the men indicted on May 7.
