Man runs from law enforcement, unaffected by taser, pepper spray

SHONNY BRANCH – A Salyersville man was arrested after running for police reporting to a call about a male subject trying to break into a Shonny Branch residence.

According to police reports, on January 2, just before 6 p.m., police were called to a residence on Shonny Branch reporting a man trying to get inside the home. Upon Magoffin County Sheriff Department Deputy W. Lafferty arriving to the home, he observed a man in a field across from the residence. Police gave the man several commands to stop, but he ran from law enforcement, across the creek and onto the side of a hill, where Deputy Lafferty was able to catch up to him. Lafferty deployed his taser, then his OC spray, but neither were effective. The man continued to run back across the creek, where Deputy Lafferty and a bystander was able to get him cuffed and placed into police custody.

The man, identified as Dustin Risner, 38, of Shonny Branch, in Salyersville, kicked the back window out of the police vehicle as he was being transported from the scene, and was trying to climb out of the police car, according to the arrest report.

Both police officers pulled over and were able to get him back into the car. At this point, Deputy Salyer and Deputy Watson were also at the scene. Before they were able to remove Risner from the now damaged police car and place him in a unit with bars on the back windows, he climbed out of the back of the police car, again, falling head-first onto the pavement, cutting the top of his head, according to the arrest citation.

The officers were able to get him into the back of Deputy Salyers’ vehicle, where he then started to kick the doors and headbutt the cage, according to the citation.

He was finally transported to the Big Sandy Regional Detention Center, facing the following charges: public intoxication – controlled substance (excludes alcohol); fleeing or evading police, second degree (on foot); resisting arrest; third-degree assault of a police officer or probation officer; criminal mischief, second degree; menacing; disorderly conduct, second degree; and escape, third degree.
